Terms & Conditions of Use

Welcome to Plazi. By accessing or using our platform (web, mobile app, APIs), you accept these Terms & Conditions in their entirety. If you disagree, please do not use Plazi.

1. Definitions

Plazi or "the Platform": the marketplace operated by Plazi SAS, a Colombian corporation with NIT [TO BE ASSIGNED], domiciled in Bogotá, Colombia.

User: any natural or legal person who registers or uses the Platform.

Buyer: User who purchases products through Plazi.

Seller: User verified through KYC process who offers products through Plazi.

Order: confirmed purchase order of one or more products.

2. Purpose of the Platform

Plazi is a technology intermediation platform that connects Buyers with verified Sellers, exclusively Colombian. Plazi does NOT sell products on its own behalf: it acts as an intermediary, facilitating the transaction, payment collection, and logistics.

The direct commercial relationship for the purchase is between the Buyer and the Seller. Plazi provides the platform, integrated payment services, and operational support.

3. User registration and account

To buy or sell on Plazi, you must create an account with a valid email and OTP authentication.

The User is responsible for the confidentiality of their account and all activity that occurs from it. Plazi is not responsible for unauthorized access resulting from User negligence.

Accounts are personal and non-transferable. Creating fake, multiple, or impersonated accounts is prohibited.

4. Sellers · KYC process

Every Seller must complete a KYC (Know Your Customer) process including verification of:
- Citizenship ID (Cédula) or NIT (legal entity)
- Updated RUT (tax registry)
- Bank account in the registered holder's name
- Colombian domicile

Plazi reserves the right to approve, reject, or suspend any Seller account that does not meet requirements or engages in fraudulent practices.

5. Plazi commission

Plazi charges a 10% (ten percent) commission on the subtotal of each Order delivered to the Buyer. This commission:
- Is calculated on the product value (does not include shipping)
- Is automatically deducted from the Seller's payment
- Settlements happen every Monday, for Orders marked "delivered" the previous week
- Returns proportionally reverse the commission

Plazi reserves the right to modify the commission with 30 calendar days' notice.

6. Payment methods

Plazi accepts the following payment methods:
- Nequi (mobile transfer)
- Daviplata
- PSE (debit from bank account)
- Credit or debit card (Visa, Mastercard, American Express)
- Cash on delivery (cash or POS terminal upon receipt)

All digital payments are processed by Wompi (Bancolombia S.A.), regulated by the Colombian Financial Superintendence. Plazi does not store card data.

7. Shipping and logistics

Shipping is operated by third-party logistics providers (Servientrega, Coordinadora, 99 Minutos, among others).

Estimated delivery times are:
- 24 hours in Bogotá, Medellín, Cali, Barranquilla, Cartagena, Bucaramanga, Pereira and Manizales
- 48 to 72 hours in other capital cities
- 5 to 7 business days in rural areas or remote municipalities

Plazi offers free shipping on orders over $150,000 COP subtotal. Below that, a variable shipping fee applies by destination.

8. Prohibited products

It is strictly prohibited to offer on Plazi:
- Weapons, ammunition or explosives
- Illegal psychoactive substances or restricted-sale medications
- Counterfeit products or products infringing intellectual property
- Perishable food without guaranteed cold chain
- Live animals
- Sexual services or pornography
- Products requiring special license without valid documentation

Non-compliance results in immediate account suspension and report to competent authorities.

9. Right of withdrawal and returns

In accordance with Article 47 of the Consumer Statute (Law 1480 of 2011), the Buyer has the right to withdraw within 5 business days following delivery, without need for justification.

Additionally, for defective or non-conforming products, the period is 30 calendar days from delivery.

10. Limitation of liability

Plazi is not a direct party to the purchase between Buyer and Seller. Plazi is not responsible for:
- Quality, authenticity or conformity of products offered by Sellers
- Logistical delays attributable to third-party operators
- Indirect damages, lost profits or damages arising from use of the Platform

Plazi guarantees reasonable Platform availability but does not guarantee uninterrupted operation.

11. Intellectual property

All Platform content (the "Plazi" brand, logos, source code, designs, editorial texts, proprietary photographs) is the exclusive property of Plazi SAS.

Products published by Sellers are the property of or licensed to the respective Sellers, who guarantee they have the rights to use the images and descriptions they publish.

12. Modifications

Plazi may modify these Terms at any time. Substantial changes will be communicated to Users with at least 15 calendar days' notice, via email and Platform notification.

Continued use of the Platform after changes implies tacit acceptance.

13. Dispute resolution and applicable law

These Terms are governed by the laws of the Republic of Colombia.

Any dispute will preferably be resolved by conciliation before an authorized center. Failing agreement, the parties will submit the conflict to arbitration at the Arbitration and Conciliation Center of the Bogotá Chamber of Commerce, with one (1) arbitrator, in Spanish, with seat in Bogotá D.C.
